1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of roshanamarujala.com (the “Site”), operated by Roshan Amar Ujala (“we,” “us,” “our”). By accessing or using the Site you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Site. You must be at least 16 years old (or the minimum digital-consent age in your jurisdiction) to use the Site.
2. Intellectual Property Rights
All content on the Site, including text, writing, articles, photographs, images, graphics, video, audio, design, layout, logos, and the compilation of all content, is the property of Roshan Amar Ujala or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Third-party trademarks, logos, and press coverage shown on the Site remain the property of their respective owners and are used only for identification, attribution, and commentary.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, publicly display, modify, create derivative works from, sell, or exploit any content without our prior written permission, except for brief quotation with proper attribution and a link, as permitted by applicable fair-use / fair-dealing law. All rights not expressly granted are reserved.
3. Acceptable Use
You agree not to:
- scrape, crawl, harvest, or use automated means (bots, spiders) to extract data or content, except legitimate search-engine indexing that respects our
robots.txt; - send spam, chain messages, or unsolicited communications through any contact mechanism;

- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Site, its servers, or connected networks (including denial-of-service attempts);
- introduce malware, viruses, or harmful code;
- infringe any intellectual-property or privacy right, or use the Site for any unlawful, defamatory, harassing, or fraudulent purpose;
- remove, obscure, or alter any copyright, trademark, or other proprietary notices, including any watermarks on documents or images.
4. User Content (Contact Form & Communications)
The Site does not host public user-generated content. If you send us information through the contact form, the newsletter signup, or email (“Submissions”), you grant us a non-exclusive, royalty-free licence to use, store, and process those Submissions solely to respond to you and to operate the Site (for example, to reply to your inquiry or send a newsletter you requested). You represent that your Submissions are accurate, that you have the right to send them, and that they do not violate any law or third-party right. Do not submit confidential or sensitive information you do not wish us to hold.
5. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any content is accurate, complete, or current. Content is provided for general informational purposes only and does not constitute professional, legal, or other advice. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ROSHAN AMAR UJALA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT YOU PAID US TO USE THE SITE (WHICH IS ZERO), WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply; in such cases our liability is limited to the smallest extent permitted by law.
7. Indemnification
You agree to indemnify, defend, and hold harmless Roshan Amar Ujala from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
8. Governing Law & Jurisdiction
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Subject to Section 9, you agree to the exclusive jurisdiction of the courts at New Delhi, India for any dispute not subject to arbitration.
9. Dispute Resolution, Binding Arbitration & Class-Action Waiver
Please read this section carefully, it affects how disputes are resolved.
Except for (a) small-claims matters and (b) claims for injunctive relief to protect intellectual property, any dispute arising out of or relating to the Site or these Terms will be resolved by final and binding individual arbitration rather than in court, administered under the rules of a recognized arbitration body, on a single-arbitrator, documents-and/or-virtual basis where possible.
Class-Action Waiver: disputes will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to a jury trial.
30-Day Opt-Out: you may opt out of this arbitration section by emailing roshanamarujala@gmail.com with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms; opting out does not affect the other Terms.
10. Termination
We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms. Upon termination, the licence in Section 2 ends and you must stop using the Site. Sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution) survive termination.
11. Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Changes to Terms
We may modify these Terms at any time by posting the revised version with an updated “Last Updated” date. Material changes will be highlighted on the Site. Your continued use after changes take effect constitutes acceptance.
